Zonerider - Free Windows Hotspot Software

This agreement (the "Agreement") is a contract between you and Zonerider Networks LTD. ("ZRN") for accessing the Zonerider Internet access Network (the "Network"). Please read the following information carefully. By agreeing on the 'Wireless Network Sign-Up' page or otherwise, you acknowledge that you (1) have read, understood and agree to be bound by this Agreement, (2) are receiving a non-transferable, single-user, limited license solely to access the Network, subject to the terms and conditions herein and (3) are at least of legal age (18). The effective date of this Agreement is the date on which you accept the terms and conditions of the Network.

Description of Network
ZRN will provide the Network at ZoneRider ZONES ("Zones") that have agreed to host the ZRN wireless access point Network (the "Network") and which are operational. ZRN does not screen or restrict access to any content placed on or accessible through the Internet. ZRN also does not screen or restrict communications between parties via the Internet. You acknowledge that you may receive or be exposed to content, that you might consider being improper, inaccurate, misleading, defamatory, obscene or otherwise offensive. You agree that ZRN is not liable for any action or inaction with respect to any such content accessible through the Network.

ZRN may provide you with technical support, via email, website FAQ sections as well as an Zonerider and Zonemaster forum and a technical support phone line, by calling the number indicated on the website, please note that this is a special rate number, calls are charged at the current rate shown on the website, extra cost may be occurred if phoning from a mobile phone or from outside the UK.:

Your Responsibilities
To assist us in providing service, you might be asked to provide details of equipment being used (including computer hardware and software, personal digital assistants, wireless network cards, etc.) to connect to the Network, You are required to protect the password, username and security information you use to access the Network and you must notify ZRN immediately of any unauthorized use of your account, and (undertake to comply with local, and international laws and regulations, including but not limited to copyright and intellectual property rights laws.

You agree to be responsible for and to bear all risk and consequences for (1) the accuracy, completeness, reliability and/or usefulness of any content made available through equipment attached by you to the Network(including other networks accessed) and (2) all communications via the Network. ZRN does not make any undertaking regarding the security of any data you send through the Network and it is your responsibility to secure such data.

It is your responsibility to keep your account information current, including personal and credit card information. Changes can be communicated via the ‘Account’ link at www.zonerider.net

Payment and Term
You shall pay all fees incurred through you relating to the service contracted by you and charged to your credit card, debit card or otherwise for access to the Network plus any applicable taxes and other fees imposed as a result of this Agreement.

Access Time
Access time bought from a Hotspot is calculated from the moment the access time is purchased until the access time expires according to the time of purchase. For example a if you buy an hours access at 12pm mid-day 1 hour later (1pm) your account will expire and will require a recharge

Billing Periods and Billing Conventions

Unlimited Rate Plans. The commencement time/date of the initial billing period is the time/date that the registration process is successfully completed.

In the event Zonerider is unable to charge fees to the credit card number you have provided, you remain responsible for any such charges and agree to pay by another means acceptable to Zonerider.

Termination
Termination is automatic through non-renewal. You agree that Zonerider may terminate this Agreement and cancel Network for any and all accounts you may have at any time, without notice and for any reason including, but not limited to, , violation of any of the terms and conditions of this Agreement, providing inaccurate registration information, and using the Network to perform any illegal activity. You further agree that in the event of termination for any reason Zonerider will have no liability to you.

Zonerider may reject an application or terminate this Agreement for any reason including, but not limited to, if (1) you violated this Agreement as to this or another Zonerider account, (2) the information required in the registration process is incorrect, absent or incomplete,

Privacy Policy
The information you provide will not be provided to any third parties in a manner that would identify you unless Zonerider is required to disclose such information in order to comply with applicable laws or unless you consent. YOUR NAME AND ADDRESS WILL NEVER BE DISCLOSED TO ANY THIRD PARTIES OF THE NETWORK

Notice of Defect Refunds or Credits
If you experience a problem accessing or using the Network, report the problem by contacting ZRN via the about page on the website or posted on the Web-site, within seven (7) days of the date on which the problem occurred. After seven days, any complaints regarding a problem are deemed waived. If ZRN determines its Network is at fault, ZRN’S sole obligation under this Agreement is to provide remedy in a manner consistent with ZRN’s regular business practices. ZRN provides no guarantee and makes no representation that the Network will be available at any particular Zone. Credits and refunds will not be issued for reasons of temporary unavailability of the Network at a particular location. Refunds or credits will be awarded solely at the discretion of ZRN, and will only be awarded after proof of purchase is provided within 28 days, and are subject to a 5% handling fee. Proof of purchase does not include ZRN Customer receipts or Paypal receipts.

Modifications
Zonerider may at its sole discretion modify the terms and conditions of this Agreement including its Rate Plan. Such modifications shall be binding and effective upon posting on Zonerider's 'Wireless Signup' page. You agree to periodically review Zonerider's 'Wireless Signup' page to maintain awareness of any modifications. By continuing to use the Network after such postings, you accept and agree to any and all such modifications.

Indemnification
You shall defend, indemnify and hold Zonerider and its corporate affiliates and their respective officers, directors, stockholders, employees, agents, successors and assignees harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable legal fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your use of the Network or any breach of this Agreement.

Warranty
Zonerider warrants that the Network will conform, as to all substantial operational features, to Zonerider currently published specifications and will be free of defects, which substantially affect Network performance. THE WARRANTY PROVIDED IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY ZONERIDER. ZONERIDER MAKES AND YOU RECEIVE NO WARRANTY EXPRESS OR IMPLIED, AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. ZONERIDER SHALL HAVE NO LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT FOR CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE STATED EXPRESS WARRANTY IS IN LIEU OF ALL LIABILITIES OR OBLIGATIONS OF ZONERIDER FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE DELIVERY, USE, OR PERFORMANCE OF ANY OF THE NETWORK.

Limitation of Liability
ZRN’S LIABILITY TO YOU UNDER THIS LICENSE, AND YOUR EXCLUSIVE REMEDY FOR ANY LOSS, DAMAGE OR INJURY, REGARDLESS OF THE NATURE THEREOF AND SPECIFICALLY INCLUDING INDEMNITY, BREACH OF CONTRACT, NEGLIGENCE, TORT, AND WARRANTY CLAIMS SHALL NOT EXCEED, AND SHALL BE LIMITED TO, THE FEE PAID BY YOU TO ZRN.

Entire Agreement, Applicable Law, Forum
This Agreement constitutes the entire agreement between you and ZRN. This Agreement shall be construed under the Law of England. All disputes relating to this Agreement or the Network shall be brought in the jurisdiction of the English courts
